Welcome to Next Rise Media, LLC ("we," "our," "us"). These Terms & Conditions govern your use of our website at nextrisemedia.com and all related services offered by us. By accessing the website or engaging with any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services Offered
Next Rise Media provides a range of digital marketing services including, but not limited to:

• Paid Advertising (e.g., Meta, Google, LinkedIn)

• Social Media Management

• Branding & Creative Content

• Web Design & Development

• Strategy and Consulting

We offer both one-time projects and ongoing retainer-based services.
We reserve the right to engage third-party partners or subcontractors in delivering services, where appropriate, without affecting the quality or terms of delivery.

2. Payment Terms
All services are billed on a monthly basis unless otherwise agreed in writing. Payment is due according to the schedule outlined in the client agreement or invoice.
We do not charge late payment fees. However, delays in payment may result in a pause of services.
Refunds or partial refunds may be considered on a case-by-case basis, depending on the nature of the project and progress made at the time of the request.

3. Revisions & Scope Changes
We offer unlimited revisions unless stated otherwise in a specific proposal.
Any change in project scope or requests for additional services beyond the original agreement may incur extra charges, which will be quoted and agreed upon in writing before proceeding.

4. Intellectual Property
Clients retain full ownership of all final deliverables upon completion and full payment.
Next Rise Media reserves the right to showcase finished work (not raw data or internal documentation) in our portfolio, unless otherwise requested by the client in writing.

5. Cancellations
Due to the custom nature of our services, we do not allow cancellations once a project has commenced.

6. Confidentiality

We treat all client information, assets, and strategic data as strictly confidential, even in the absence of a formal Non-Disclosure Agreement (NDA).

7. Limitation of Liability & Disclaimer of Results
While we apply industry best practices, we do not guarantee specific outcomes such as sales, traffic, engagement metrics, or search rankings unless explicitly stated in a written agreement.
We shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our website, services, or deliverables.

8. Indemnification
Clients agree to indemnify and hold harmless Next Rise Media, its owners, employees, and subcontractors from any and all claims, liabilities, or damages arising from the use or misuse of deliverables, platforms, or services provided.

9. Use of Third-Party Tools
We may use third-party tools such as advertising platforms, analytics software, and automation tools when executing campaigns.
Services may be carried out using either the client’s business accounts or under accounts managed by Next Rise Media, as agreed upon in writing.
We are not responsible for limitations, changes, outages, or service issues caused by these external platforms.

10. Force Majeure
Next Rise Media shall not be held liable for any delay or failure in performance due to acts beyond our control, including but not limited to natural disasters, internet outages, labor strikes, third-party software failures, or government regulations.

11. Jurisdiction

These Terms & Conditions are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts located in New Mexico.

12. Modifications
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page at nextrisemedia.com/terms, and your continued use of our services constitutes acceptance of those changes.
